Privacy policy
How we handle your personal information when you visit this website or contact us.
Draft: this privacy policy will be reviewed by legal counsel before publication.
1. Who we are
This website is operated by FNLY IT LLC, 406 Suburban Drive, Suite 2700, Newark, DE 19711, USA ("FNLY IT", "we", "us"). FNLY IT LLC is responsible for the personal information collected through this website.
Phone: +1 (562) 514-4234, email: info@fnly-it.com. You can use this address for all privacy questions and requests.
2. Information we collect when you visit
When you open a page, your browser sends technical information to our server so the page can be delivered. This includes:
- IP address of your device
- date and time of the request
- the page or file requested
- the website you came from (referrer)
- browser and operating system
- amount of data transferred and the response status
Our server uses this information only to deliver the requested page. We do not store access logs containing this information.
If you open fnly-it.com without a language in the address, we forward you to the matching version of the site. To do this we derive your country from your IP address and take your browser's language setting into account. The lookup uses a database on our own server (IP geolocation by DB-IP, db-ip.com, license CC BY 4.0). Your IP address is not shared with anyone for this purpose and is not stored.
If you pick a language version yourself in the language selector, we store that choice in a cookie ("fnly_it_locale", kept for one year) so we do not redirect you again on your next visit. The cookie only contains the code of the version you chose.
3. Consent banner and local storage
We do not use advertising cookies. Your choice in the consent banner is stored in your browser's local storage under the key "fnly-consent", so the banner does not appear on every page. This storage is necessary to remember your choice.
Services that are not strictly necessary only load after you consent. You can change or withdraw your consent at any time with the "Cookie settings" link in the footer of every page.
4. Analytics with Matomo
If you consent to the "Analytics" category, we use the open source software Matomo to measure how our website is used. Matomo runs at statistik.fnly-group.com on servers of the FNLY Group in Germany, which operates analytics for all websites of the group. We do not share this data with third parties outside the FNLY Group.
We process your IP address, shortened by the last two bytes before it is stored, the pages you view and how long you stay, the website you came from, information about your device, browser and screen size, and actions such as submitting a form. Matomo sets the cookies "_pk_id" (kept for 13 months) and "_pk_ses" (kept for 30 minutes).
We use these statistics to improve our content and to understand which pages lead to inquiries. Raw data is deleted after 395 days.
5. Advertising and ad measurement
If you consent to the "Marketing" category, we use services of the platforms where we run ads: Google Ads (Google LLC), the LinkedIn Insight Tag (LinkedIn Corporation), the Meta Pixel for Facebook and Instagram (Meta Platforms, Inc.) and the TikTok Pixel (TikTok Inc.). Without your consent, these services are not loaded.
These services set cookies or similar identifiers and receive information such as your IP address, device and browser details, the pages you visit and whether you sent an inquiry or booked a call. We use this to measure which ads lead to inquiries and to show ads to visitors of our website on these platforms. Under some state privacy laws this can count as sharing personal information for cross-context behavioral advertising. You can withdraw consent at any time through the cookie settings link in the footer, and we honor Global Privacy Control signals as an opt-out.
If you reach us through an ad and send an inquiry, we include the campaign details from the page address, such as utm_campaign or gclid, with your inquiry, so we can see which campaign led to which inquiry.
6. Contact form
When you write to us through the contact form, we process the information you enter: name, email address, company, phone number, the topic you chose, the approximate number of users and your message.
We use this information to answer your request and, if requested, to prepare a quote. Our server sends your message as an email to our Microsoft 365 mailbox through Microsoft Graph. We do not keep a database of form submissions. To prevent abuse, the server holds your IP address briefly in memory to limit repeated requests. It is not stored and is discarded after one hour at the latest.
7. Booking an intro call
We use Microsoft Bookings for online scheduling. Your browser does not connect to Microsoft directly. The calendar on this page asks our server for open times, and only your booking is sent from our server to Microsoft Bookings. No cookies are set in this process.
When you book a call, we process your name, email address, company, phone number, your optional note and the time you chose, so we can hold the call and send you a confirmation. As with the contact form, the server holds your IP address briefly in memory to prevent abuse.
8. Contact by email and phone
When you contact us by email or phone, we use your information to handle your request. Support requests from clients are recorded as tickets so every request can be traced.
9. Hosting
This website runs on servers we operate ourselves in a data center of Hetzner Online GmbH in Germany. Hetzner provides the data center, power and network connection. Information you submit through this website is processed in Germany and the European Union.
The connection to this website is encrypted with TLS. You can recognize this by "https" in the address bar.
10. Service providers
We share personal information only with service providers that need it to deliver our services, under contracts that limit their use of the information:
- Hetzner Online GmbH, Gunzenhausen, Germany: hosting of this website and our analytics
- Microsoft: Microsoft 365 for email, calendar and Microsoft Bookings
This website also links to other providers, for example to download TeamViewer QuickSupport or to our founders' LinkedIn profiles. No data is sent to them until you click such a link. Their own privacy policies apply on their sites. Without your consent we do not load fonts, scripts or images from third-party servers; ad tags load only after you consent to the “Marketing” category.
11. International data transfers
Our website and analytics data are stored in Germany. Email and booking data is processed in Microsoft 365, and Microsoft may process this data in the United States or other countries where it operates. By using this website or contacting us, you understand that your information may be processed outside your state or country.
12. How long we keep information
We delete inquiries once they are resolved, unless we need to keep them for legal, tax or accounting reasons. If your inquiry leads to a contract, we keep related records for as long as the law requires. Analytics raw data is deleted after 395 days. The price calculator and the Security Readiness Check run entirely in your browser. Your answers there are neither stored nor sent to us.
13. Security
We protect your information with technical and organizational measures, including TLS encryption for all connections, access restricted to the people who need it, and multi-factor authentication for our systems. No method of transmission or storage is completely secure, but we work to protect your information and review our measures regularly.
14. Your choices and rights
You can contact us at any time to ask what personal information we hold about you, to correct it or to have it deleted. You can withdraw your consent to analytics at any time in the cookie settings. We respond to requests within the time required by applicable law.
15. Your California privacy rights
If you live in California, the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA) gives you the following rights:
- Right to know what personal information we collect, use and disclose, and the sources and purposes
- Right to delete personal information we collected from you, subject to legal exceptions
- Right to correct inaccurate personal information
- Right to opt out of the sale or sharing of your personal information
- Right to limit the use of sensitive personal information, where applicable
- Right not to be discriminated against for exercising your rights
We do not sell personal information for money. If you consent to marketing cookies, our advertising tags (Google Ads, LinkedIn Insight Tag, Meta Pixel, TikTok Pixel) may count as sharing personal information for cross-context behavioral advertising. You can opt out at any time through the cookie settings link in the footer or with a Global Privacy Control signal.
The categories of personal information we collect are identifiers and contact details (name, email, phone, company), internet activity (pages viewed, only with consent), and the content of your messages. We collect them from you directly and from your browser, for the purposes described in this policy.
To submit a request, email info@fnly-it.com with the subject "Privacy request". We will verify your identity by matching information you provide with information we hold. You may use an authorized agent to submit a request on your behalf. We may ask the agent for written permission from you and may ask you to verify your identity directly.
16. Other US state privacy laws
Residents of other states, such as Colorado, Connecticut, Virginia, Texas and Oregon, may have similar rights under their state privacy laws, including the right to access, correct, delete and obtain a copy of their personal information and to opt out of targeted advertising, sale or profiling. You can exercise these rights in the same way by emailing info@fnly-it.com. If we deny your request, you can appeal by replying to our decision, and we will review it again.
17. Children's privacy
This website is directed to businesses and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will delete it.
18. Do Not Track and Global Privacy Control
We honor Global Privacy Control (GPC) as a valid opt-out of sale and sharing. If your browser sends a GPC signal, our advertising tags are not loaded, even if you accept marketing cookies. There is no common standard for browser "Do Not Track" signals, so we do not respond to them separately.
19. Changes to this policy
We update this privacy policy when our website or the law changes. The date at the top of this page shows when it was last updated. The version published here applies.
20. Contact
